Terms of Use

1. Agreement

By downloading, installing, or using BrowserView ("Application"), you agree to these Terms of Use ("Terms"). If you do not agree to the Terms, do not use the Application.

2. Service Description

BrowserView is a macOS application designed for web developers and designers. The application allows you to preview and test websites on multiple devices simultaneously using WebKit and Chromium (CEF) engines. The application is distributed directly through the website browserview.app in DMG format.

3. Subscription Terms and Payment

A paid subscription is required to access BrowserView features.

• Payment methods: bank cards (Visa, Mastercard, MIR), YooMoney wallet. Payments are processed by YooKassa (NCO "YooMoney", Central Bank of Russia license).
• Renewal: subscriptions do not auto-renew. After the paid period ends, you can renew your subscription on the website.
• Refund: refund is available within 14 days of payment, provided the Application has not been used. Contact us by email for a refund.

4. License Key and Activation

After payment, you receive a unique license key linked to your email. The key must be entered in the Application for activation. The license key is personal and may not be transferred to third parties.

5. License to Use

Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use BrowserView for personal or professional purposes on one computer.

6. Acceptable Use

You agree not to:

• reverse-engineer, decompile, or disassemble the Application;
• distribute, sublicense, rent, or resell the Application or license keys;
• use the Application for illegal purposes;
• attempt to bypass the licensing or activation system;
• remove or alter copyright and trademark notices.

7. Intellectual Property

BrowserView and all related content, design, code, and functionality are the property of ИП Полетаев Сергей and are protected by Russian copyright and intellectual property law. Chromium Embedded Framework is used under the BSD license.

8. Updates

The Application may automatically check for updates via the Sparkle system. Updates include bug fixes, security improvements, and new features. Installing updates is recommended but not required.

9. Disclaimer of Warranties

The Application is provided "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

• uninterrupted, error-free, or secure operation of the Application;
• accuracy, completeness, or reliability of rendering results;
• compatibility with all hardware configurations and macOS versions;
• availability of the Application or licensing servers at all times;
• that the Application will meet your requirements.

Web page rendering is performed by the built-in WebKit and Chromium (CEF) engines, which may differ from the behavior of corresponding browsers on end-user devices. Web content displayed in the Application is provided by third-party websites and is beyond our control.

By paying for a subscription and using the Application, you confirm that you accept it in its current state and acknowledge the stated limitations.

10. Limitation of Liability

To the maximum extent permitted by Russian law:

• We shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of profits, data, business reputation, or missed opportunities, arising from the use or inability to use the Application.
• We shall not be liable for damage caused by rendering errors, display discrepancies on actual devices, licensing server failures, or data loss.
• Total liability under these Terms is limited to the amount actually paid by you in the last 12 months of using the Application.

You use the Application at your own risk. All responsibility for the results of using the Application lies with you.

11. Personal Data

Personal data processing is governed by our Privacy Policy, which is an integral part of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms. The current version is always available on this page with the update date. Significant changes will be communicated to you by email. Continued use of the Application after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Russian Federation. Disputes shall be resolved in court at the location of ИП Полетаев Сергей, unless otherwise provided by consumer protection legislation.
